I felt so annoyed at the neighbours after they told me there was a huge illegal
generator buried buneth the green tarp and rocks I removed 3 x 10sq cubic feet of dirt. 3 bins

alone cost 6k and one of the bins broke because of the dence dirt. I had to pay for the broken
truck. The neighbours constantly harrassed me and generally told the workers what to do when
I was not there.
20. I obtained a Builder s and an Engineer s reports to advise on the state of the building to
help me and my architect decide the best way forward. They confirmed the dilapidated state of
much of the building. They referred to water runoff from the neighbourand#39;s property at 7 George
St and the pavement into the property as being a major problem.
21. At no stage did I intend to pull down the building, it was purchased for Priya and I. I
had no idea what I had got myself into. The building was fucked. Although, now that the
neighbours contacted Council mistaking my intentions, resulted in a stop work order being
imposed, with which I have complied. The building has detioriated far worse over the past year
due to the neighbours 7 George Street totally removing their gutters.
22. I lodged plans with Council having been informed that the old dwelling would need to
be partly reconstructed to comply with the current building regulations. I also wished to add a
new extension.
23. On or about late June /early July I received the results from a Survey which was
required by Council before they considered my plans lodged earlier. The Survey dated 26 June
2018 had been sent to George St rather than my residential address, and I found it opened and
without any envelope, floating in water in the backyard.
24. I read the Survey and found its contents confusing. The Survey referred to the size of
my land as being 106 square metres rather than the 109 square metre property described in
the S32 when I bought the property.
25. On or about 17 September 2018, I received by mail the Plaintiff s application for
Adverse Possession. I was surprised as I would have thought the neighbours would have
approached me about it first, and explained the situation. I interpreted the application as
meaning that part of my land was affected and was to be claimed by Mrs Hartsias in her
Application. I believed that the land was once part of my Title.
26. I also read a short comment on the Survey from my architect. I formed a view that the
next door neighbours may have become aware of my Title Re-establishment Survey, and lodged
their Adverse Possession claim in response.
27. My architect made mention of moving the fence, and that comment formed part of the
basis for my decision to move it.
28. However, in the light of advice more recently received from my Surveyor, I now accept
that I am not in a position to oppose the adverse possession claim. This has been very difficult
for me to accept.
29. Prior to receiving that advice, on 23 September 2018. I removed the fence adjoining
the two properties, believing that the fence was incorrectly located.
30. I did not harass Mrs. Hartsias. I rang the doorbell intending to explain to Mrs Hartsias
that I was going to remove the fence. There was no answer. About 30 minutes later Mrs
Hartsias came out and said I m going to call the Police. I said : That s OK. I did not act in an
intimidating manner. I did not say not to call the police. I tried to speak to Mrs Hartsias about
the generator issue but the conversation went nowhere so I walked off. I had not conversed
with Mrs Hartsias before and had never entered her property before.
15 minutes after moving the fence I received continious phone calls.
31. The fist phone call I received at 11.48am, 15 minutes after leaving 5 George Street
Windsor. (refer to recording). Number 0421805939.
32. The second phone call from 0421805939 was received at 11.49am on the 23 rd
september 2018 and lasted 3 minutes and 3 seconds. It was threatening saying who the fuck
am I - I believe genuine harm was intended. I believe I know who made the call.
33. The third phone call from 0421805939 was received at 11.52am on the 23 rd september
2018 . I hung up.
34. The fouth phone call from 0421805939 was received at 12.27pm on the 23 rd september
2018 . Lasted 2 minutes and 45 seconds of listening to the most foul mouth person I have ever
heard.
35. The fith phone call from 0421805939 on the 23 rd september 2018 lasted 3 minutes and
28 seconds at 12.35pm. This time I was at Prahan Police station and constable Jake Conner and
his partner took my phone. Both received abuse from the caller. I honesty donand#39;t think the calller
believed they were speaking to the police.
36. At 12.45pm on the 23 rd september 2018 another call was received from 0421805939
lasting 25 seconds and abusive and threating.
37. Senior Constable Jake Conner thought what he belived to be Joanna in the background
as he previously spoke to them regarding the fence moving matter on on the 23 rd september
2018 ,
38. At that time Priya and I did not feel safe and both officers at their discretion sent 2
patrol officers onsite to meet 25 Andrew Street Neighbours.
