Elaras Clydesdale Neighbourhood sits within a heritage zone which requires development consent from Blacktown City Council (Council) under the Environmental Planning and Assessment Act 1979 (NSW) (EPA Act) in order to build on the property.

Council has approved a planning proposal to remove the heritage zone affecting Clydesdale Neighbourhood. The planning proposal remains subject to review and finalisation by the Department of Planning and Environment (NSW) (Department).

If the Department approves the planning proposal, it is anticipated that Clydesdale Neighbourhood will be removed from the heritage zone and landowners may be able to seek approval to build on their property through a complying development certificate under the EPA Act and the provisions of the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 (NSW).

If the heritage zone has not been removed by the time landowners own their property, landowners may be required to seek development consent from Council for approval to build on their property rather than through a complying development certificate.

Contracts for sale for the purchase of a property in Clydesdale Neighbourhoood are not conditional on the removal, or procuring the removal, of the heritage zone affecting the property. Potential purchasers must make their own enquiries in relation to the heritage zone, the prospects for removal from the heritage zone and approvals required for building on the property.
